Minutes of Meeting
January 5, 2011

Members present: Chairman Thomas Jameson, Vice-Chairman Richard Moore, Ex-Officio Jeffrey Jordan, Richard Arell, Stan Brehm, Kevin Mara, Allen Mayville, Thomas Houle (Alt.) and Secretary Jamie A Pike.

Chairman Jameson called the meeting to order at 6:30pm.

The minutes of December 2, 2010 were reviewed and a motion was made by Mr. Jordan and seconded by Mr. Mayville to approve the minutes with a correction acknowledging Mr. Arell’s presence at the meeting.  Motion passes.

Public Hearing:  Zoning Amendments
Chairman Jameson opened the public hearing upon the proposed amendments.  Mr. Jameson read each ballot question and provided a brief summary of the intent of each amendment.
ZONING AMENDMENT No. 1
Are you in favor of the adoption of Amendment No. 1 as proposed by the Planning Board for the town zoning ordinance as follows:  To ratify the adoption of Section 3.18 Outdoor Lighting and subsequent amendments made thereto?

Ms. Kate Hall proposed amendments including height, reduction of exterior afterhours lighting, and compliance deadlines.

A motion was made by Dr. Mara and seconded by Mr. Brehm to amend the article to change the compliance date for existing lighting to January 1, 2016.

ZONING AMENDMENT No. 2
Are you in favor of the adoption of Amendment No. 2 as proposed by the Planning Board of the town zoning ordinance as follows:  To ratify the adoption of Section 3.19 Open Space Conservation Development and subsequent amendments made thereto?

There was no further discussion regarding this article.

ZONING AMENDMENT No. 3
Are you in favor of the adoption of Amendment No. 3 as proposed by the Planning Board of the town zoning ordinance as follows:  To ratify the adoption of Section 2.04:F District CV: Commercial Village and subsequent amendments made thereto?

There was extended discussion regarding the intent and purpose of this ordinance.  Many arguments were presented from the audience in opposition to this ordinance as it is an excessive property right taking.  The Board explained that this ordinance was designed from the Route 4 corridor study and provides a long term projection for the design of the area.

ZONING AMENDMENT No. 4
Are you in favor of the adoption of Amendment No. 4 as proposed by the Planning Board of the town zoning ordinance as follows:  To ratify the adoption of Section 3.20 Noise Abatement?

There was no further discussion regarding this article
ZONING AMENDMENT No. 5
Are you in favor of the adoption of Amendment No. 5 as proposed by the Planning Board of the town zoning ordinance as follows:  To ratify the adoption of Section 3.21 Accessory Dwelling Units?

There was no further discussion regarding this article.

ZONING AMENDMENT No. 6
Are you in favor of the adoption of Amendment No. 6 as proposed by the Planning Board for the town zoning ordinance as follows:  To ratify the adoption of Section 2.04:H District WFH: Workforce Housing Overlay District?

There was no further discussion regarding this article.

ZONING AMENDMENT No. 7
Are you in favor of the adoption of Amendment No. 7 as proposed by the Planning Board for the town zoning ordinance as follows:  To ratify the adoption of a requirement that all road frontage shall be contiguous?

Examples were presented by the Board to the audience present of the intent of this ordinance where in the past its absence has allowed the creation of oddly shaped lots and furthers sprawl and overdevelopment of property.

ZONING AMENDMENT No. 8
Are you in favor of the adoption of Amendment No. 8 as proposed by the Planning Board for the town zoning ordinance as follows:  To ratify the adoption of Article XI Definitions and subsequent amendments made thereto?

There was no further discussion regarding this article.

Chairman Jameson called for a roll call vote on the recommendation of each of the preceding amendments.

Public Hearing:

SITE REVIEW REGULATION AMENDMENT No. 1
Shall the Planning Board vote to approve Amendment No. 1 as proposed for the town Site Review Regulations;  Section V(F) Outdoor Lighting Regulations as follows:  To incorporate those amendments made to Section 3.18 Outdoor Lighting of the town zoning ordinance?

The purpose of this amendment is to clarify the prohibition of electronic message boards, the use of high intensity beams, and the display of signs that move, flutter, blink or flash.  This section also includes standards for luminaire design, placement and height standards.

There was lengthy discussion regarding the allowance of uplighting and how much could or could not be accomplished.

 A motion was made by Mr. Jameson and seconded by Mr. Jordan to approve the amendment as presented. Motion passes.

Being no further business before the Board, a motion was made by Dr. Mara and seconded by Mr. Brehm to adjourn the meeting at 9:30pm.  Motion passes.
